Changes to Planning Use Laws affecting the Private Rented Sector
As many landlords will know, the RLA has been campaigning vigorously, along with others, to oppose changes to planning law which will affect houses and flats which are let to groups of sharers (eg. students, migrants, young professions etc). These changes take effect as from 6th April 2010. The changes are not retrospective.
After the 6th April 2010, if you rent out a house or flat which was previously occupied by a single person or a family to such a group you could then need planning permission. You will need planning permission if the new changed use is such as to amount to a “material change of use”. How these new rules will be interpreted and applied is far from certain.
If, as at the 6th April 2010, the house or flat concerned was already in shared use by a group of up to six, who were living together as a single household, then you will not need planning permission. You already have established lawful shared use. It does not matter for how long prior to the 6th April 2010 the house or flat was used in this way.
The new law is intended to apply where there is a change of use of a house or flat (which has previously been occupied by a family etc whether it is owner/occupied or rented) to shared use by between three and six unrelated individuals. It only applies where the new use of the house or flat is a shared use by unrelated individuals who are not members of the same family/relatives and the property is rented out in the private rented sector.
This can include lettings by owner/occupiers of their own homes involving three or more unrelated individuals who are living with them. The new rules do not apply to the social sector (ie. lettings of Council houses or properties rented out by Housing Associations). For planning consent to be needed there must be a material change of use.
Use by more than six tenants may have needed planning permission under the old rule. This will continue to be the case and this also applies to the social sector as well as private renting.

Residential Property Market May Slow Ahead of Election
Britain’s upcoming parliamentary election this May will likely slow down any recovery in the country’s residential property sector, with more investors set to wait until after a new government is formed before purchasing real estate, reports the RLA
London Central Portfolio published research suggesting that it is common for the uncertainty prior to a general election to make investors more cautious of expanding their portfolios. While this will likely result in a temporary slow down in transactions, London Cental Portfolio pointed to statistics collected by the Land Registry to argue that the weeks immediately after an election usually result in an upswing in activity for the property sector.
The recent uncertainty injected into an otherwise predictable campaign due to polls showing the Tories leading Labour by a smaller margin than previously thought may also convince more investors to wait until after the vote. The potential for a hung parliament might also make investors jittery and fearful of political instability. But observers note that braver investors may have a golden opportunity to snap up residential properties for bargain prices as the market slows before the election, only to sell them at a profit once the sector picks up soon after the government has formed.
The pattern already witnessed before previous elections appears to be repeating itself. Statistics published by Halifax and HM Revenue suggest that residential property values dropped by 1.5 and the number of transactions also started to decline in February. But if the 2005 election was any indication, prices will rise noticeably after the vote. In the last general election, values increased by 5.2 percent in the three months following polling day.

Right Move and RICS report a glut of houses coming onto the market in March; The beginning of this month has seen the highest rise in new properties coming on to the market and there has been a resultant levelling off in house prices.
A glut of houses means it is a buyer's market and the seller needs to ensure that their estate agent has all marketing tools at hand and in action, in order that their property is top of the viewing pile.

Over 65s Own Property Worth £765.18bn
New research commissioned by independent equity release adviser Key Retirement Solutions has revealed that British pensioners have property wealth totalling circa £765.18bn.
The news comes as the housing market continues its hesitant recovery, and marks the launch of Key Retirement Solutions’ Pensioner Property Equity Index which intends to measure the property wealth of the over 65s every quarter.
Most property wealth is in the south east (£123.44bn) with London in second place (£122.65bn).
Business Development Director Dean Mirfin has stressed that the housing market was hard hit by the recent economic woe and emphasised the fragility of the recovery.
Mirfin went on to say that as many properties were purchased decades ago they nevertheless represent a phenomenal success in financial terms for the country’s pensioners, and offer a potential income unaffected by low interest rates which are making savings accounts less attractive.
